CONGW. JAYE LACSON, MISTER AT KAGAWAD INIREKLAMO NG ‘QUALIFIED THEFT’ SA ‘INANGKIN’ NA DSWD FOOD PACKS

NAHAHARAP sa panibagong reklamo sa Office of the Ombudsman si Malabon Congresswoman Jaye Lacson-Noel, asawang si Florencio “Bem” Noel, at ang kagawad na si Romulo “Ibot” Cruz kaugnay ng “iligal” na pag-repack ng relief goods mula sa Department of Social Welfare and Development (DSWD) na pasok umano sa kasong ‘qualified theft’.

Sa reklamong inihain ni Rogelio Gumba, dating tauhan ng congresswoman, nakasaad ang pinagdaanang baha ng Malabon dulot ng bagyong Carina noong July 22, 2024 kung saan nabigyan ito ng mga family food pack mula sa DSWD.

Gayunpaman, sa halip na direktang ipamigay ang food packs ng DSWD sa taumbayan, nagsagawa muna ng repacking activity si Congw. Jaye kasama ang kanyang mister na si Florencio at ang kagawad na si Cruz.

Sa complaint affidavit ni Gumba, siya ang inatasan ng tanggapan ng congresswoman na kumuha ng mga family food pack sa DSWD sa Pasay City kasama ang isang driver ng kongresista. Karamihan umano ng mga food pack ay dinala sa “white house” o headquarters ni Lacson-Noel sa Tonsuya, Malabon habang ang iba ay dinala sa mga opisina ng Barangay Longos, Hulung Duhat at Tinajeros.

Pagdating umano ng mag-asawang Lacson-Noel sa headquarters ay nagsimula ang repacking ng mga relief good. Katulong si Kagawad Ibot ay nag-repack ang mga tauhan ng kongresista kungsaan ang 6 kilos na bigas ng DSWD ay hinati sa dalawang pakete na tag-3 kilos na lamang. Hinati-hati rin ang ilang delata at inilagay sa plastic bags.

Ang ibang ni-repack na relief goods ay ipinamahagi ng mag-asawang Noel habang ang iba pang delata ay hindi na ipinamigay.
Ayon kay Gumba, maliwanag na nagkaroon ng paglabag ang mag-asawang Noel sa Republic Act No. 10121 (Philippine Disaster Risk Reduction Management Act of 2010). Malinaw din na nagkaroon ng ‘Qualified Theft’.

Pagkatapos ng repacking ay sinimulan na umano ng mag-asawang Noel kasama si Gumba at iba pang staff ang pamamahagi ng mga ni-repack na relief goods sa mga constituent nito. Pero pinalabas na ang mga ipinamahaging relief goods ay galing sa mag-asawang Noel at hindi sa DSWD, dahil sinasabi raw ng mga ito sa mga binibigyan na: “Konting tulong lang po mula sa amin.”

“Spouses are misleading the public into believing that the relief goods came from them and not from the source, the DSWD,” ani Gumba, na paglabag sa Republic Act No. 3019 (Anti-Graft and Corrupt Practices Act).

Sa nangyaring pag-repack sa DSWD relief goods, na pinalabas na tulong ng mag-asawa sa kanilang nasasakupan at sa pagtatago ng iba pang items na hindi ipinamigay, ay malinaw ang mga elemento ng qualified theft: (1) there was a taking of personal property; (2) the said property belongs to another; (3) the taking was done without the consent of the owner; (4) the taking was done with intent to gain; (5) the taking was accomplished without violence or intimidation against person, or force upon things; and (6) the taking was done under any of the circumstances enumerated in Article 310 of the RPC.

“As member of the House of Representatives, Cong. Jaye was authorized to receive and distribute relief packs from the office of DSWD. Such a position or relation of trust and confidence was aptly established to have been gravely abused when she made it appear that the distributed goods belong to them, in addition to the fact that they did not distribute some of the goods contained in the said relief box.

“Further, conspiracy between respondents’ Cong. Jaye, Bem, and Kgg. Ibot are very much present in this case. In terms of proving its existence, conspiracy takes two forms. The first is the express form, which requires proof of an actual agreement among all the co-conspirators to commit the crime. However, conspiracies are not always shown to have been expressly agreed upon,” giit pa ni Gumba.

Bukod sa qualified theft, paglabag sa RA No. 10121, RA No. 3019 at Revised Penal Code, nilabag din umano ng mag-asawang Noel at Kagawad Ibot ang RA No. 6713 o Code of Conduct and Ethical Standards for Public Officials and Employees.
