KASO SA TIN CAN MANUFACTURERS, IBINASURA!

Bahagi ng patas na pamamahayag ay may isang naikolum ang ARYA na may titulong “OFFICIALS NG CAN MANUFACTURERS KINASUHAN!” noong July 26, 2023 ay nagpahatid ng kalatas ang nasabing kompanya na nagsasaad sa sitwasyon ng kasong kinakaharap ay IBINASURA na o dinismiss na ng korte ang usapin sa puntong walang sapat na ebidensiyang magdidiin sa 2 opisyal ng kompanya.

Sa ipinadalang letter ni ORIENTAL TIN CAN & METAL SHEET MFG CHAIRMAN RAMON CHUA na may petsang August 24, 2023 na nitong nakaraang Biyernes (September 8, 2023) natanggap ng inyong lingkod ay isinaad ang;

“We write in reference to the Newspaper Article dated 26 Jul 2023 posted on https://www.policefilestonite.net/ regarding the criminal cases filed against some of the directors and/or officers of Chua Tee & Company, Inc. (the “Corporation”). We note that in said Newspaper Article, it was mentioned that there are pending cases between and among the family members who own the Corporation, to wit-

Makaraang madiskubre ang 4 na beses na pag-encash mula sa pondo ng kompanya sa 2 banko ay kasong 4 counts of Qualified Theft ang kasong isinampa ng Caloocan City Prosecutor’s Office sa CEA/ President at si Felimon Dexter N. Chua, COO/General Manager kapuwa ng Chua Tee & Company na nagnenegosyo sa ngalan ng Oriental Tin Can & Metal Sheet Mfg.. na ang mga ito ay pinatawan No Bail.

Bukod sa kaso ng 2 Chua ay kinasuhan din ni Ong sa Quezon City Prosecutors’ Office sina Ivee Lyn Chua at Lea Felysse Gatchalian dahil ang huli ay minor age pa lamang noong naging Director ng CTCI at ang naging rekomenda ni QC City Prosecutor Vilmar Barcellano ay piyansang tig-P36,000 sa 2 inakusahan.

Please be advised that the cases referred to in said Newspaper Article have already been dismissed for lack of probable cause. Specifically, in the criminal case involving the checks which was docketed as C-123443-46, the Regional Trial Court of Caloocan City- Branch 242 issued an Order dated 14 June 2023 which ruled that there was no probable cause to wit-

WHEREFORE, the instant cases docketed as C-123443 to 123446 are hereby DISMISSED for lack of probable cause. SO ORDERED.

With respect to the Falsification Case referred to in the aforesaid Online Article, the Regional Trial Court of Quezon City – Branch 76, relative to the case docketed as Case No. R-QZN-23-04915-CR, issued. Resolution dated 25 July 2023 dismissing sid case also for lack of probable cause, to wit-

WHEREFORE, having failed to substantially rise reasonable grounds to believe that a crime of Falsification of Public Document has been committed by accused Chua and Gatchalian, this Court has no other recourse but to DISMISS the complaint for lack of probable cause. The warrant for the arrest of Lea Felysse C. Gatchalian is ordered lifted or cancelled and the cash bail posted by Accused Ivee Lynn N. Chua for her temporry release as evidence by Official Receipt No. 9749383 in the amount of Thirty Six Thousand Pesos (P36,000.00) is ordered released to her, subject to applicable accounting procedures.”
