Hirit ng legal team ni Digong anti-poor

HINILING ng defense counsel ng nakakulong na dating presidente ng bansa, Rodrigo “Digong” Duterte, sa International Criminal Court (ICC) na limitahan ang bilang ng mga dokumento ng mga biktima na lalahok sa trial laban kay Digong.

Sa dokumento na isinumite sa ICC registry noong April 7, hiniling ng abogado ni Digong na si Nicholas Kaufman na limitahan ang pagtanggap ng uri ng identification documents ng mga biktima, hinirit na tanging national ID o kasalukuyang Philippine passports lamang ang payagan.

“Limiting the range of identity documents enhances the reliability of the identity verification process and significantly reduces the risk of fraud. The use of varied and insufficiently verified identity documents could lead to misidentification, double-counting, and the inclusion of false victims – issues that could trigger unnecessary and time-consuming litigation,” hirit sa dokumento ni Kaufman.

Kung sakaling wala raw national ID o kasalukuyang Philippine passport, okey narin sa kanila ang ID ng Social Security System (SSS).

“The Registry fails to explain why such deviation is appropriate or even necessary in this case, other than the vague assertion that there exists a ‘backlog in the distribution of national identity (ID) cards,’” sabi sa dokumento.

Para naman kay ICC Assistant to Counsel Kristina Conti, ang kahilingan ni Kaufman sa pre-trial chamber hinggil sa paglahok ng mga biktima ay “out of touch and harsh” at ito ay “intended to exclude the majority of the victims of Duterte’s war on drugs.”

“Their insistence on the use of national IDs is unrealistic, with the obtention and issuance of the cards plagued with consistent issues of delay. Their suggestion to produce passports is anti-poor, as only the socially mobile have the luxury to avail of cross-country travel,” diin ni Conti sa kanyang statement.

“Limiting the list of possible proofs of identity only discourages victims unnecessarily, almost heartlessly,” dagdag niya.

Tinuligsa rin ng International Law expert na si Atty. Joel Butuyan ang komento ni Kaufman sa mga uri ng IDs na dapat i-require sa mga lalahok na biktima, sinabing pagpapakita lamang ito ng kanilang kakulungan sa pag-intindi sa Philippine context. Aniya, ang mga hinihirit ni Kaufman na mga dokumento tulad ng national IDs at kasalukuyang pasaporte ay accessible lamang sa mga mayayaman at pribilehiyo sa Pilipinas.

Sinabi ni Butuyan na ang mga uri ng IDs na hinihirit ni Kaufman ay mga dokumentong nagsi-signify sa mayayaman at pribilehiyo sa Pilipinas, na kungsaan ay hindi accessible sa mga biktima na nabubuhay lamang sa kahirapan.

“The victims families have already lost loved ones. For them to be refused recognition as victims of the murderous Mr. Duterte, because of their lack of government-issued IDs, is to make them suffer grave injustice twice over,” diin niya sa statement.

Inanunsyo ng ICC na patuloy silang nagsasagawa ng mga imbestigasyon sa iba pang sangkot sa war on drugs ni Digong. At maari nitong ipaaresto rin ang mga ito kapag napatunayang ‘guilty’ sa walang awang mga pagpatay.

Kabilang sa mga iniimbestigahan sina ex-PNP Chief ngayo’y reelectonist Senatior Ronald “Bato” Dela Rosa, ex-PNP Chief Oscar Albayalde at walo pang mga dating opisyal ng nakaraang administrasyon.
