Mahigpit na pagpapatupad vs ‘kabit system’ laban sa tiwaling PUVs

EPEKTIBONG paraan ang pagpapatupad ng “subcontracting” upang maiwan at kontrahin ang “kabit system” modus ng ilang consolidated public utility vehicle operators.

Sinabi ito ni Quezon Province 3rd District Representative Reynante Arrogancia, House transportation committee vice-chairman, matapos ang pagtalakay sa pinakahuling pagdinig ng komite ukol sa PUV Modernization Program.

Nabatid na ang kabit system ang ginagamit ng ilang unconsolidated PUJ operators na tutol magpa-consolidate sa mga kooperatiba o korpora-syon.

Ayon kay Arrogancia, masama ang kabit system dahil sinasamantala ng “kabit-operator” ang kinakabitan nito para maka-pagkunwaring lehitimong consolidated operator.

“The kabit enjoys being pseudo-legit but does not assume any business risk and does not follow the rules. LTFRB and OTC should watch out for the kabit PUV units and operators. They should have ways to quickly identify which units are ‘kabit,’” paglilinaw ni Arrogancia.

Hinimok ni Arrogancia ang Land Transportation Franchise and Regulatory Board (LTFRB) at Dept. of Transportation (DOTr) na magkaroon ng “safeguards” upang matiyak na hindi makakaabala o makakagulo sa operasyon at pananalapi o finance ng consolidated operators ang mga hindi sumanib sa korporasyon, maliban kung ang mga ito ay pumaloob sa “special arrangement” o ang iligal na “kabit system.”

Ayon sa mambabatas, ang tanging arrangement na maaaring payagan sa PUV Modernization Program ay ang tinatawag na “subcontracting.”

Payo ni Arrogancia sa LTFRB at OTC na marapat magpalabas na ng patakaran kung saan “clearly defined, delineated, and delimited are the specific conditions under which the subcontracting arrangements can be used as an exception to the general rule.” (Henry Padilla)
